Evaluations in English, French, and through a language interpreter
Extreme Hardship Evaluations
During this process, I will work with the immigration attorney and their client to identify the psychological distress deportation would impose on the qualifying relative(s). This process typically consists of a consultation with the immigration attorney, an interview with their client, possible collateral interviews, a review of pertinent records, possible psychological testing, analyzing the information gathered according to the relevant legal standard(s), and, if the attorney decides that results from the evaluation are favorable to their client’s legal position, a written comprehensive report. Expert witness testimony is also offered if requested.
Citizenship Examination Waiver
During these evaluations, I evaluate naturalization applicants to determine if the individual has a “physical or developmental disability or mental impairment” and how it impairs their functioning as it relates to their capacity to learn and demonstrate knowledge and understanding of English and/or U.S. history and government. This process typically consists of a consultation with the immigration attorney, an interview with their client, possible collateral interviews, a review of pertinent records, and possible psychological testing. If the applicant demonstrates such impairments, I then fill out the Medical Certification for Disability Exceptions (N-648 certifications).
Competency to Represent Self in Immigration Court
During this type of evaluation, I will assess whether the examinee has a mental illness or developmental disability that impairs their capacity to understand the Immigration Court proceedings, assist their attorney or representative if there is one, and present their case in Immigration Court. This process typically consists of a consultation with the immigration attorney, an interview with their client, possible collateral interviews, a review of pertinent records, possible psychological testing, analyzing the information gathered according to the relevant legal standard(s), and, if the attorney decides that results from the evaluation are favorable to their client’s legal position, a written comprehensive report. Expert witness testimony is also offered if requested.
